What is a lasting power of attorney (LPA)?

What is a lasting power of attorney (LPA)? A Lasting Power of Attorney (LPA) is a crucial legal document that enables your voice to be heard by giving the people you trust the power to make health and/or financial decisions if you become unable to do so yourself. Having a Lasting Power of Attorney in place means that should you suffer a serious illness or accident and lose mental capacity then your chosen Attorney’s can act for you.

It is a service that can be provided to you alongside making a Will or separately, but it is a must have for all adults and should be considered as important as making a Will. Without a Lasting Power of Attorney (LPA) money in bank accounts may be frozen and your family members may not be able to make the decisions you would regarding your care and medical treatment.

There are two types of LPAs:

  • Health and Welfare LPA: This gives the attorney the authority to make decisions about the donor’s personal welfare, including medical care, if the donor is unable to do so.

  • Property and Financial Affairs LPA: Allows your attorney to manage your financial matters, such as bank accounts and property, and can be used with your permission once registered.

What happens if you don’t make a Lasting Power of Attorney (LPA)?

If you were to suffer a serious accident or illness, lose mental capacity or no longer wish to make decisions for yourself then your chosen Attorneys can immediately act for you if you have a Lasting Power of Attorney (LPA).

Without a Lasting Power of Attorney your relatives will need to apply to the Court of Protection for Deputyship which can be a very stressful, lengthy and expensive process at a time that you need it least. This can also cost thousands of pounds due to court, solicitors and medical report fees and take a long time to get the permissions you need from court.
